What to do?

Important: Your options depend on your contract type. Check if you have an employment contract (umowa o prace) or a civil law contract (umowa zlecenie, umowa o dzielo).

Send a formal payment demand

Send a formal payment demand letter via registered mail. This is required before taking further legal steps.

Report to PIP

File a complaint with the National Labour Inspectorate (Panstwowa Inspekcja Pracy - PIP).

Note: PIP only has jurisdiction over employment contracts (umowa o prace). If you have a civil law contract (umowa zlecenie or o dzielo), PIP cannot help. Even with an employment contract, PIP may not be fully effective due to bureaucracy.

Start court proceedings

If you have an employment contract (umowa o prace): File a lawsuit with the Labour Court (Sad Pracy). This is free for claims up to 50,000 PLN - you don't need expensive lawyers.

If you have a civil law contract (umowa zlecenie, o dzielo): Use EPU (Electronic Writ-of-Payment Proceedings) at e-sad.gov.pl. The fee is only 1.25% of the claim value.

EPU can only be used for claims that became due within the last 3 years.

If they fail to respond within 14 days, you automatically win the case!

Bailiff (Komornik)

After obtaining a valid court judgment or payment order, refer the case to a bailiff (komornik) who will handle the debt collection.
